None appeared from either side. It is seen from the record that the matter was listed on various dates, however, there appears to be no representation on behalf of the parties on various occasions. Today, when the matter was called upon for hearing, none appeared, either for the Operational Creditor or for the Corporate Debtor. On perusal of the papers and records available before this Tribunal and also taking note the continuous non-appearance on the part of Operational Creditor and Corporate Debtor, further strengthens belief of this bench that the Operational Creditor is no more interested to prosecute the matter.
In view of the facts and circumstances narrated hereinabove, this Tribunal has left with no option, except to dismiss this Company Petition.
Resultantly, the C.P.(IB)-640(MB)/2020 is dismissed for non-prosecution. File be consigned to records. All the pending IA’s/MA’s in this Company Petition become infructuous, hence stood dismissed. File be consigned to records.
