K.C. Puri, J.—Petitioner - Ashok Verma has applied for grant of regular bail in FIR No. 346 dated 21.10.2009 under Sections 363, 366, 120-B IPC (Section 376 IPC added later on), registered at Police Station Jodhewal, Ludhiana.

2.

As per allegation of the prosecution, the prosecutrix, aged 15 years, was allured by the Petitioner - Ashok Verma, Vinod Kumari, his wife and Varinder Verma, their son. It is further alleged that Varinder Verma committed rape upon the prosecutrix in the house of aunt of Varinder Verma. The role attributed to the Petitioner - Ashok Verma is that he told the prosecutrix to sit on the motor cycle of Varinder Verma alongwith Vinod Kumari.

3.

Vinod Kumari is stated to have been allowed the concession of anticipatory bail. The Petitioner is in custody since 22.10.2009. The previous bail application of the Petitioner was dismissed as not pressed vide order dated 1.4.2010.

4.

So, without commenting on the merits of the case, in my view it is a fit case to allow the concession of bail. Bail is granted to the Petitioner - Ashok Verma, to the satisfaction of the trial Court.
