Judgment
Ajay Rastogi, J.—Matter has come up on 2nd stay Appl. No. 1913/2010 seeking permission to appear in B. Pharma (Part-IV) examination scheduled to commence on 05/07/2010.
Counsel inter-alia submits that Petitioners are students of B.Pharma course and vide order dt.19/03/2010 they were provisionally permitted to appear in B.Pharma (Part-III) (Suppl.) Examination commenced on 22/03/2010; and on the result being placed for perusal, Petitioner-1 has passed out the examination but despite opportunity being afforded, result of Petitioner-2 has not been placed on record. Counsel submits that if the Petitioners are not permitted to appear in the rest of the papers of B. Pharma (Part-IV) having commenced on 05/07/2010, it would cause prejudice to them.
Taking note of material on record, this Court considers it appropriate to grant permission to appear in the examination. Accordingly, 2nd stay application stands disposed of; and the Respondents are directed to permit the Petitioners to appear in rest of papers of B.Pharma (Part-IV) (Main and Suppl.) examination having commenced on 05/07/2010 on provisional basis; and their participation will not confer any right and the result be kept in a sealed cover and shall not be declared till further orders.
