Judgment
M.M. Kumar, J.—This petition filed under Article 226 of the Constitution prays for issuance of a writ in the nature of mandamus directing respondent No. 1 to decide the representation dated 5.5.2006 (P-2) against recording of adverse remarks in the ACR for the period 1.4.2004 to 2.11.2004 and to pass final order in the disciplinary proceedings initiated vide charge sheet dated 11.7.2003 (P-4), after deciding representation of the petitioner, dated 13.3.2006 (P-6). A further prayer has been made to direct the respondents for considering the case of the petitioner for promotion to the post of Executive Engineer without taking into account aforementioned ACR (P-1) and disciplinary proceedings (P-4).
For the relief claimed in the instant petition, the petitioner has already made representations dated 5.5.2006 and 13.3.2006 (P-2 and P-6 respectively) to the respondents. Without going into the merits of the case, we deem it just and appropriate to direct respondent No. 1 to take cognizance of the aforementioned representations, dated 5.5.2006 (P-2) and 13.3.2006 (P-6) sent by the petitioner and decide the same expeditiously preferably within a period of four months from the date a certified copy of this order is presented to him. It shall be appreciated if a speaking order is passed.
Petition stands disposed of in the above terms.
