Judgment

Heard Mr. Shankar Lal Agarwal, learned counsel appearing on behalf of the petitioner.
Heard Mr. Ram Prakash Singh, learned counsel appearing on behalf of the opposite party No. 2-complainant.
Learned counsel for the petitioner at the outset submits that he wants to confine his argument on the point of sentence. He has further submitted that the cheque involved in the present case is to the extent of Rs. 35,000/- and the petitioner had given altogether 7 cheques and this was the only cheque which had bounced and rest all were honoured. He also submits that the petitioner, on the earlier occasion also, was ready to compromise the matter through the Lok Adalat and was ready to pay the amount, but at that point of time, it was not acceptable to the opposite party No. 2. He submits that the learned court below has awarded compensation to the extent of Rs. 35,000/- and fine of Rs. 2,000/- has also been imposed and the petitioner has been sentenced to six months simple imprisonment. He submits that during the pendency of this case, the petitioner has remained in custody for a period of 1 month 12 days and as on date, the petitioner is ready to pay twice the cheque amount, i.e. Rs. 70,000/- within a period of two months from today, if the opposite party No. 2- complainant accepts the same by way of compromise.
Upon this, the learned counsel for the opposite party-complainant submits that he shall seek instructions from his client and if she is ready, then he would file joint compromise petition in the present case. He submits that let the matter be posted on 21.10.2021 so that the instructions may be communicated to this court.
Considering the aforesaid submissions, the matter is directed to be posted on 21.10.2021.
