Judgment

1.This matter is taken up through hybrid mode.
It appears that by order dated 16th May, 2016, a coordinate Bench of this Court had directed to place the matter before Hon'ble the Chief Justice, as the assignment of Criminal Misc. Case and Criminal Revision are different to be heard by one Bench. Thereafter, it appears that no such order has been obtained from Hon'ble the Chief Justice by the Registry since then.
However, in the meanwhile, both the cases can be taken up by this Court inasmuch as the assignment of this Criminal Misc. Case and the Criminal Revision are within the roster of this Court. But, in view of the order of a coordinate Bench to place the matter before Hon'ble the Chief Justice, it would not be proper on my part to take up the matter without a specific order of Hon'ble the Chief Justice in this regard.
As such, the matter be placed before Hon'ble the Chief Justice immediately, as Mr. Mahitosh Sinha, learned counsel appearing for the Petitioner submits that the trial is going to be proceeded with in this case and his client is going to be prejudiced by the same, and necessary order be obtained in this regard.
