Judgment

The present petition has been filed under Articles 226/227 of the Constitution of India for issuance of a writ in the nature of MANDAMUS directing the respondents to constitute a separate Sabha Area by bifurcating and including the area from the Sabha Area of Village Seman as it fulfills the conditions required for constituting separate Panchayat in view of provisions of Sections 7 and 8 of the Haryana Panchayati Raj Act, 1994.
At the very outset, learned counsel for the petitioner submits that a detailed representation was moved by the petitioner on 02.11.2018 (Annexure P-1) but no action has been taken thereupon so far. Learned counsel further submits that the petitioner would be satisfied, in case, the directions are issued by this Court to consider the pending representation within some stipulated period.
Keeping in view the limited prayer of the petitioner, the present petition is disposed of with a direction to respondent No.5 i.e
Deputy Commissioner, Rohtak, District Rohtak to take action on the pending representation dated 02.11.2018 (Annexure P-1) in accordance with law preferably within a period of three weeks from the date of receipt of certified copy of the order.
The petition is disposed of accordingly.
However, it is also directed that the resolution passed by the Panchayat be taken into consideration.
