Learned counsel for the applicant no.2-Satendra Parihar seeks permission of this Court to withdraw this application under section 483 of BNSS, 2023 with liberty to renew his prayer after reasonable time.

Prayer is allowed.

Accordingly, this application for grant of bail of the applicant no.2-Satendra Parihar is dismissed as withdrawn with the aforesaid liberty.

Heard the application (I.A.NO.22388/2025) of applicant no.1-Ashok Bhadoriya for grant of temporary bail.

This is first bail application under Section 483 of BNSS filed by the applicant for grant of temporary bail.

The applicant has been arrested on 1.10.2025 by Police Station- Hazeera, District Gwalior in connection with Crime No.333/2025, registered in relation to the offence punishable under Section 34 (2) of M.P. Excise Act.

Learned counsel for the applicant submits that the applicant is suffering from jaundice and prayed that the applicant be granted temporary bail to receive medical treatment for the same.

The aforesaid factum has been verified and not disputed by the State counsel.

Considering the aforesaid, this application for interim bail is partly allowed and it is hereby directed that the applicant shall be released on interim bail for a period w.e.f. 17.10.2025 to 26.10.2025 on his furnishing a personal bond in the sum of Rs.50,000/- (Rupees Fifty Thousand only) with one solvent surety of the like amount to the satisfaction of the concerned trial Court.

It is directed that applicant shall surrender on 27.10.2025 before the concerned trial Court, failing which, the interim bail order shall stand cancelled automatically without further reference to this Court. Further, the surrender report of the applicant shall be submitted by the concerned Court to the Registry of this Court for information. It is also directed that if applicant fails to surrender, the concerned trial Court shall take appropriate steps for securing his arrest.

Accordingly, present application stands partly allowed and disposed of.

A copy of this order be sent to the Court concerned for compliance.
