Judgment
Petitioner herein seeks quashing of FIR No. 0297/2023 dated 13.09.2023, registered at Police Station Mayapuri, Delhi, for commission of offences under Sections 288/337 IPC, along with all consequential proceedings arising therefrom, on the basis of compromise arrived at between the parties.
Some construction activity was being carried out at House No. C-86, Khajan Basti, Mayapuri and on 13.09.2023, Shri Laxmi Narayan (respondent No.2 herein), who is a resident of the adjacent premises, was outside his house, when during said ongoing construction, one wooden plank fell upon him, resulting in injuries on his forehead.
Fortunately, injuries were found simple in nature.
Charge-sheet has already been filed.
Quashing is being sought as matter has now been amicably settled between the parties.
Copy of Settlement Deed dated 25.06.2026 has been placed on record. It indicates that parties have entered into amicable settlement on account of intervention and counseling of nears & dears, relatives, friends and neighbours and that they have sorted out their disputes amicably and, therefore, the injured has undertaken that he would co-operate in quashing of the FIR.
Respondent No.2 is present in Court and has been duly identified by his counsel as well as by Investigating Officer.
When asked, respondent No. 2 reiterates the terms of settlement and submits that he would have no objection if the FIR in question is quashed as the matter has been amicably settled. He submits that towards reimbursement of his medical expenditure and as compensation, he has already received a sum of Rs. 35,000/- from the petitioner. He states that he has entered into the abovesaid settlement out of his own free will, without any coercion and influence from any corner whatsoever and therefore, he would have ‘no objection’ if FIR in question is quashed. His affidavit to abovesaid effect has also been placed on record.
In view of the settlement arrived at between the parties, continuing with criminal proceedings would serve no useful purpose, especially, when dispute does not involve any public interest and is, primarily, private in nature. In any case, even the complainant does not wish to press any charges against the petitioner.
Accordingly, exercising inherent powers vested in this Court under Section 528 of Bharatiya Nagarik Suraksha Sanhita, 2023, it is deemed appropriate to quash the instant FIR.
Consequently, to secure the ends of justice, FIR No. 0297/2023 dated 13.09.2023, registered at Police Station Mayapuri, Delhi, for commission of offences under Sections 288/337 IPC, along with all consequential proceedings arising therefrom, is, hereby, quashed.
Original affidavits and Settlement Deed, copies of which have been placed on record in the present proceedings, shall be submitted before the learned Trial Court within four weeks from today, so that these become part of Trial Court Record.
The present petition stands disposed of in aforesaid terms.
