We think that the Deputy Magistrate acted bond fide from a mistaken view of the law and that therefore there is no good ground for transferring the case. We direct him to proceed with the trial. We desire to point out that he should at once give the accused an opportunity to cross-examine the prosecution witnesses, if they should so desire, even though the charge may not be framed.
