Judgment

This criminal appeal under Section 14-A of SC/ST Act is preferred being aggrieved by the order dated 22.12.2025 in Special Case No.237/2025 by Special Judge SC/ST (POA) Act, 1989, Ratlam arising out of Crime No.563/2025 registered at P.S. Industrial Area, Ratlam for the offences punishable under Sections 69 of BNS, 2023 and Section 3(2)(v) of SC/ST Act and sections 3/5 of the Madhya Pradesh Freedom of Religion Ordinance, 2020.
A report be called from the Special Judge, SC/ST (POA) Act, 1989, Ratlam on which dates the summons were issued and to whom the summons were issued.
A report be also called from the In-Charge Police Station- Industrial Area, District- Ratlam on which date they received the summons and why the summons have not been returned back and why witnesses have not been kept present before the trial court especially in such a sensitive matter where the allegations are of the conversion of the religion.
A report be also called from the Special Public Prosecutor SC/ST Court what steps he has taken to secure the presence of the witnesses and in case there was non-compliance then what attempts were made by him in this regard.
Accordingly, P.S.-Industrial Area, District- Ratlam (MP) is directed to keep the witnesses present under protection before the trial court on 25.02.2026.

Copy of this order be forwarded to the Special Judge, SC/ST (POA) Act, Ratlam as well as P.S.-Industrial Area, District- Ratlam (MP) and Special Public Prosecutor SC/ST Court for compliance.
