Judgment
Samaresh Banerjea, J.—The present appeal has been preferred by the tenant Defendant against the judgment and decree dated. December 16, 1997, passed in Ejectment Suit No. 111 of 1986 by the learned VIII Judge, City Civil Court at Calcutta. The Ejectment suit was filed by the landlord on the ground of reasonable requirement and the Trial Court has granted the decree having found that the Plaintiff does require the suit premises reasonably.
Admittedly the Defendant was a monthly tenant under the Plaintiff in respect of one self contained flat being flat No. 9 consisting of two rooms, Kitchen, bath and privy in the aforesaid second floor of premises No. 13-A, Balaram Ghosh Street, P.S. shyampukur, Calcutta-700004.
In the plaint it has been specifically pleaded by the Plaintiff that he reasonably requires the suit premises for his own use and occupation and for use and occupation of his family members and he is not in possession of any other reasonably suitable accommodation.
