This is an application filed under Section 439 Cr.P.C seeking regular bail.
The petitioner is the sole accused in Crime No.268/2022 of Chattannoor Police Station, registered alleging offence punishable under Section 20(b) (ii)(b) of the Narcotic Drugs and Psychotropic Substances Act, 1985.
The prosecution case is that on 30.04.2022 at around 12.05 a.m, near the JSM Hospital, Chathannoor, the accused was found in possession of 1.200 kilograms of ganja. Hence the accused is alleged to have committed the offence punishable under the above mentioned sections. The accused was arrested on 30.04.2022 and he has been in judicial custody since then.
Heard both sides.
It is submitted by the learned Public Prosecutor that the final report has been filed before the court below.
In these circumstances, bail is granted to the petitioner on execution of a bond for Rs.50,000/- (Rupees fifty thousand only) with two solvent sureties each for the like sum to the satisfaction of the jurisdictional court.
