Judgment
D.P.S. Chauhan, J.—Heard learned Counsel for the Petitioner and learned Standing Counsel.
The Petitioner is a member of the U.P. Primary Agricultural Cooperative Credit Societies Centralised Services and he was suspended vide order dated 23-5-91. Against this order he filed a writ petition in this Court on 13-8-91 wherein the following interim order was granted:
Meanwhile the operation of impugned order dated 23-5-91 shall remain suspended.
The said writ petition is pending in this Court.
By means of this petition the Petitioner has prayed for quashing the order dated 28-6-91 passed by the member Secretary District Administrative Committee, Gorakhpur.
The grievance of the Petitioner is that he was not allowed to hold the charge. The Petitioner has got no right for holding the charge as it is the discretion of the employer to take work or not to take work. By means of this petition also the show cause notice dated 14-9-91 (Annexure VIII) to the petition whereby the Petitioner was required to show cause after conclusion of the disciplinary proceedings regarding imposition of punishment is being challenged. The Petitioner may show cause is response of the said notice. It is not a fit case for interference at this stage.
The petition is accordingly rejected.
