Both the aforesaid bail applications shall stand decided by this common order.

The present bail applications have been filed under Section 439 of Cr.P.C. on behalf of the petitioner who is in custody in connection with F.I.R. Nos. 212/2016 and 213/2016, Police Station Kotwali, District Sirohi for the offences under Sections 420, 406, 409 & 120-B of I.P.C.

Heard learned counsel for the petitioner and learned Public Prosecutor. Perused the material available on record.

Learned counsel for the petitioner submits that the petitioner is a lady and has falsely been implicated in the present case. He further submits that entire property of the petitioner has been attached vide Order dated 06.03.2018 passed by the Joint Secretary (Cooperation) & Central Registrar of Cooperative Societies, New Delhi. Further, the petitioner has been directed vide Order dated 16.08.2018 issued by the Liquidator that she will not transact any business from the society. He further submits that the petitioner has suffered incarceration for more than fifteen days. Therefore, he prays that the petitioner may be enlarged on bail.

Learned Public Prosecutor opposes the bail applications. Having regard to the facts and circumstances of the case and upon a consideration of the arguments advanced, this Court is of the opinion that the petitioner is entitled for grant of bail under Section 439 of Cr.P.C.

Consequently, both the bail applications under Section 439 of Cr.P.C. are allowed. It is ordered that the accused-petitioner - Smt. Asha Rawal W/o Narendra Kumar Rawal arrested in connection with F.I.R. Nos. 212/2016 and 213/2016, Police Station Kotwali, District Sirohi shall be released on bail provided she furnishes a personal bond of Rs.50,000/- (Rupees: Fifty Thousand Only) in each case with two sureties of Rs.25,000/- (Rupees : Twenty Five Thousand Only) each to the satisfaction of the learned trial court with the stipulation to appear before that Court on all dates of hearing and as and when called upon to do so.
