The original petition is filed to direct the Court of the IInd Additional Subordinate Judge, Thiruvananthapuram, to consider and dispose of E.P.No.219/2019 in O.S.No.177/2015 (Ext P1) within a time frame.
Pursuant to the order dated 23.12.2022 passed by this Court, the learned Subordinate Judge, by communication dated 06.01.2023, has informed this Court that the execution petition stands posted for return of notice and attachment report to 16.01.2023. The court below requires six month’s time to dispose of the execution petition.
Heard; Sri. K.R. Rajkumar, the learned counsel appearing for the petitioner. Even though notice of the original petition has been served on the learned counsel appearing for the respondent before the court below, there is no appearance for them.
In the light of the pleadings and materials on record and after perusing the communication of the learned Subordinate Judge, in exercise of the supervisory powers of this Court under Article 227 of the Constitution of India, I direct the Court of the learned IInd Additional Subordinate Judge, Thiruvananthapuram, to consider and dispose of E.P.No.219/2019 in O.S.No.177/2015, as expeditiously as possible and in accordance with law, at any rate, within a period of six months from the date of receipt of a certified copy of this judgment.
The original petition is ordered accordingly.
