Division Bench of this Court vide judgment dated 13.09.2017 passed in WPSB No. 243 of 2017 had directed the second respondent to take final
decision on the inquiry report within three weeks. It was further provided that, after decision on the disciplinary proceedings, a decision regarding grant
of A.C.P./promotion shall also be taken within six weeks.
Alleging disobedience of the said order, petitioner has filed this Contempt Petition.
A compliance affidavit has been filed by Mr. Tulsi Ram. Documents enclosed with the said affidavit indicate that not only the disciplinary
proceeding initiated against the petitioner was concluded; but, benefit of A.C.P. was also given to him from the due date. An order dated 03.01.2018,
whereby petitioner was notionally promoted as District Development Officer from the date his junior was promoted, is also brought on record.
In view of the documents brought on record alongwith compliance affidavit, this Court is satisfied that the order passed by Division Bench of this
Court has been substantially complied.
Accordingly, the Contempt Petition is closed.
Contempt notices issued to the respondents are hereby discharged.
