This is an application under Section 482 of the Code of Criminal Procedure, 1973 to quash the entire proceedings of Criminal Case No. 717 of 2019, “State vs.Aryan Pal and Others”, pending before the court of Judicial Magistrate, Bazpur, District Udham Singh Nagar for the offence punishable under Sections 323, 504, 506, 498A of IPC and Section 4 of the Dowry Prohibition Act, 1961.

Heard Mr. Lalit Sharma, the learned counsel for the applicants, Mrs. Lata Negi, learned Brief Holder for the State and Ms. Garima Thapa, learned counsel holding brief of Mr. Tejas Agarwal, learned counsel for the private respondent.

According to the present matter, the matter was sent for mediation. As per the report dated 06.04.2021 of the Mediator, the settlement was made between the parties with free will and without any influence and fear. The said settlement is annexed with the said report.

Mr. Lalit Sharma, the learned counsel for the applicants and Ms. Garima Thapa, the learned counsel appearing for the private respondent submitted that a complete settlement was arrived between the parties and they requested to quash the entire proceedings of the said criminal case.

Having heard the submissions of learned counsel for the parties, the entire proceedings of Criminal Case No.717 of 2019, “State vs. Aryan Pal and Others”, pending before the court of Judicial Magistrate, Bazpur, District Udham Singh Nagar for the offence punishable under Sections 323, 504, 506, 498A of IPC and Section 4 of the Dowry Prohibition Act, 1961, are quashed.

The Criminal Miscellaneous Application No.2128 of 2019, filed under Section 482 of the Code of Criminal Procedure, is disposed of accordingly.
