Judgment
Surya Kant, J.—The petitioners seek a direction to respondent-GMADA to hold draw of lots of the plots for which they are entitled to under the land pooling category and issue letter of intent/allotment letter of plots in the said category in IT City at SAS Nagar, Mohali. The petitioners further seek a direction for issuance of LOI for ''commercial area'' as per their entitlement in lieu of acquisition of their land. In addition, the petitioners have also sought a direction for allotment of 50% share of 242 Sq. Yards per acre in ''institutional category''. The above stated relief regarding allotment of residential, commercial or institutional area in lieu of their acquired land as per the Land Pooling Policy framed by the respondents, has already been sought by the petitioners vide legal notice dated 22.2.2012 (Annexure P-6).
In these circumstances, we are of the considered view that instead of adjourning the case to await the reply-affidavit to be filed by the respondents, it would be more appropriate to dispose of this writ petition with a direction to take an appropriate decision regarding the above mentioned claims of the petitioners.
Consequently, we dispose of this writ petition and direct the Chief Administrator, GMADA, to take appropriate decision on the above-mentioned claims which are also contained in legal notice dated 22.2.2012 (Annexure P-6) by passing a speaking order in accordance with the Land Pooling Policy within a period of two months from the date of receipt of certified copy of this order. Meanwhile, any allotment made shall be without prejudice to the petitioners'' right.
