Judgment
Hon''ble Prafulla C. Pant, J.—Heard. By means of this petition moved u/s 482 Cr.P.C., the petitioners have sought quashing of the proceedings of Criminal Case No. 662 of 2012, State Vs. Sahanwaj and others, relating to offence punishable u/s 387 of I.P.C., Police Station-Ranipur, District Haridwar, pending in the court of Chief Judicial Magistrate, Haridwar.
Brief facts of the case are that petitioners were workmen with M/s Rock Man Industries Ltd. SIDCUL, Haridwar. It appears that their services were terminated by the employer. They alleged that resignations were forcibly got written from them, and they raised industrial dispute before the labour court. It is contended that to pressurise the petitioners, the employer got lodged a criminal case, making allegations against the petitioners that they had threatened the employer in order to commit extortion.
Learned counsel for the petitioners pleaded that it is more a case of industrial dispute in an industry, and ingredients of the offence punishable u/s 387 of I.P.C., are not made out against the petitioners. Apart from this, it is submitted that even the complainant himself does not want to prosecute the petitioners.
Shri Jeet Singh (respondent No. 2), complainant, identified by his counsel Mr. M.S. Bhandari, Advocate, is present in the Court. He stated that he does not want to prosecute the petitioners now. It appears that there is some amicable settlement between the parties.
In the above circumstances, this Court is of the view that it is a fit case for exercising the powers u/s 482 of Cr.P.C. Accordingly, the petition u/s 482 of Cr.P.C. is allowed, and the proceedings of proceedings of Criminal Case No. 662 of 2012, State Vs. Sahanwaj and others, relating to offence punishable u/s 387 of I.P.C., Police Station-Ranipur, District Haridwar, pending in the court of Chief Judicial Magistrate, Haridwar, are hereby quashed.
