This is first bail application filed by the applicant u/s 438 of Cr.P.C. for grant of anticipatory bail.

The applicant is apprehending his arrest in connection with Crime No. 316/13 registered at P.S. City Kotwali, District Bhind, for the offence punishable under Sections 467 and 420 of IPC.

As per prosecution case, it was complained that Male Health Workers Training Center, Guna, and Female Health Workers Training Center, Bhind, have given admission on the basis of forged mark-sheets. About 84 mark-sheets have been sent for investigation to S.P., Bhind, with a direction to constitute a team and inquire into the matter. In pursuance of that, enquiry has been made. Out of 84 mark-sheets, mark-sheets of Male Health Workers whose names have been mentioned at serial No. 28 to 37 and Female Health Workers whose names have been mentioned at serial No. 23 to 35 in the letter written to S.P., Bhind, dated 22.2.2012, have not been found correct, therefore, the offence under Sections 420 and 467 of IPC has been registered.

Learned counsel for the applicant submits that co-accused Narayan Singh and Kaptan Singh have been released on anticipatory bail by this Court vider orders dated 7.8.2013 passed in M. Cr.C. Nos. 6162/2013 and 6172/13 and the case of present applicant is akin to that of co-accused. Hence, on the ground of parity, the applicant is also entitled for bail.

Learned Public Prosecutor for the State has opposed the bail application.

Taking into consideration the facts and circumstances of the case, but without commenting on the merits of the case, this application is allowed and it is directed that in the event of arrest, applicant shall be enlarged on bail on his furnishing a personal bond in the sum of Rs. 50,000/- (Rs. Fifty Thousand Only) with a surety bond in the like amount to the satisfaction of Arresting officer/competent Court. The applicant shall make himself available for interrogation by a police officer as and when required and he will co-operate in the investigation. He shall further abide by the other conditions enumerated in sub-section (2) of Section 438 of Cr.P.C.

This order shall remain operative for a period of sixty days and during this period the applicant is free to move the regular bail application before the concerned Court. C.C. as per rules.
