JASWANT SINGH, J. (ORAL)

The petitioner-Society claims to be representing the allottees of plots in a residential colony floated by M/s Pawan Goods Merchant Company

Limited, Developer at Kotkapura in the year 2008. Since the Builder had not provided basic amenities in the plotted colony, the petitioner-Society

filed CWP No.22306 of 2012, which was disposed of vide order dated 08.11.2012 (Annexure P-1) by a Division Bench of this Court, directing the

competent authority under the 'Punjab Apartment and Property Regulation Act, 1995' (in short 'PAPRA Act, 1995') to take appropriate action on the

complaint filed by the plot holders/Welfare Society within three months.

Since no action was taken within stipulated time, hence the present contempt petition.

During the pendency of the contempt, a speaking order dated 11.02.2014 stood passed by the Competent Authority/Additional Chief Administrator,

Bathinda Development Authority, Bathinda, whereby, respondent No.3/Developer Builder was required to provide the stated basic amenities within a

time frame, failing which the action was liable to be taken as per law.

It so transpires that subsequently the licence of respondent No.3/Developer Builder was cancelled vide order dated 13.09.2017 and upon exercise of

Appellate Authorities under the 'PAPRA Act, 1995', an order dated 09.01.2018 stands passed by the Appellate Authority, whereby the licence of

respondent No.3/Developer Builder has been restored, subject to completion of all the pending works within six months.

In the light of aforesaid order dated 09.01.2018, no further proceedings are warranted in the present contempt petition.
