Heard on admission/stay.
Petitioners are Forest Guards working in Forest Range Office, Sheopur. Respondent No.7 is a retired Forest Ranger from Forest Department and, as alleged, is blackmailing the petitioners and seeking their caste certificates. State Information Commissioner directed to furnish information regarding caste and domicile status of petitioners by providing relevant certificates. This is arbitrary because it is contrary to the Section 8 (1)(j) of the Right to Information Act, 2005.
Learned counsel for petitioners referred the judgement of Apex Court in the case of Girish Ramchandra Deshpande Vs. Central Information Commissioner ans others, 2013 (1) SCC 2012.
Issue notice to the respondents on payment of process fee within seven working days through registered A.D. mode, returnable within four weeks.
Till next date of hearing, effect and operation of order dated 06.02.2024 shall remain stayed.
