This Application has been filed under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 for quashing the entire proceedings of Criminal Case No.4335 of 2022, “State vs. Arun Kumar Yadav and Others”, pending before the court of Additional Chief Judicial Magistrate, Kashipur, District Udham Singh Nagar under Sections 323, 498A, 504, Section 506 of the Indian Penal Code, 1860, Section 3 and Section 4 of the Dowry Prohibition Act, 1961.

Mr. Pradeep Lohani, learned Brief Holder for the respondent no.1.

Mr. Nikhil Kushwaha, learned counsel for the respondent no.2-informant and the wife of the applicant no.1.

Applicant no.2 is the father and applicant no.3 is the mother of the applicant no.1. All the applicants are present in-person. They are identified by Mr. Sanjay Kumar, Advocate.

The respondent no.2-informant is present in-person. She is identified by Mr. Nikhil Kushwaha, Advocate.

The Applicants and respondent no.2 submitted that there were matrimonial disputes and they have resolved their disputes. They have filed a Compounding Application (IA No.1 of 2025) with affidavits with their free will and without any pressure. The respondent no.2 has requested to quash the entire proceedings of Criminal Case No.4335 of 2022.

The said request of the respondent no.2 has not been opposed by Mr. Pradeep Lohani, Brief Holder.

In the facts and circumstances of the case, ends of justice would be met if the entire proceedings of Criminal Case No.4335 of 2022, “State vs. Arun Kumar Yadav and Others”, pending before the court of Additional Chief Judicial Magistrate, Kashipur, District Udham Singh Nagar, are quashed.

Resultantly, the present Application, filed under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023, is allowed and the entire proceedings of Criminal Case No.4335 of 2022, “State vs. Arun Kumar Yadav and Others”, pending before the court of Additional Chief Judicial Magistrate, Kashipur, District Udham Singh Nagar, are hereby quashed.
