This matter is taken up through Hybrid hearing. I.A. No.561/2023 (application for condonation of delay)
1. There is stated to be a delay of 3 days in filing the present appeal due to the reasons stated in the application. The delay in filing the present appeal is stated to be neither deliberate nor intentional. After considering all facts, the delay, if any, filing the present appeal is condoned. The application is accordingly allowed. I.A. No.720/2023 (application for substitution of LRs of the respondent no.1)
The instant application is filed for substitution of the legal heirs of the
respondent no.1, Govind Agarwal who is stated to be expired during the trial ofthe
present S.A. It is stated in the para 4 of the application that the respondent has left behind the legal heirs, namely, Kamla Agarwal, Hitesh Agarwal, Khushbhu Agarwal. The surviving legal heirs of the respondent no.1 is now represented by Sh. Tushar Roy, Advocate. After considering all facts, the application is allowed and the legal heirs as mentioned in para 4 of the application are substituted in place of the respondent no.1.
