Heard learned counsel for the petitioner and learned counsel for the State.

Learned counsel for the petitioner submits that the petitioner and the victim have already got married and they have blessed with four years child

out of their wedlock. In view of such facts, the petitioner is seeking quashment of Special G.R. Case No.13 of 2015, arising out of Raghunath Palli

P.S. Case No.122 of 2014 pending in the court of learned Special Judge, Sundargarh. The petitioner is involved in the case for the commission of

offence under Sections 363, 366-A, 376(2)(i) of the IPC read with Sections 4 and 8 of the POCSO Act.

In view of the aforesaid submissions, let notice be issued to opposite party Nos. 2 and 3 through Registered Post with A.D./Speed Post fixing a

short returnable date. Postal requisites shall be filed within three working days.

List this matter on 16.02.2022.

In the interim, it is directed that there shall be stay of further proceeding of Special G.R. Case No.13 of 2015 of the court of learned Special Judge,

Sundargarh till the next date.

As the restrictions due to resurgence of Covid-19 are continuing, learned counsel for the parties may utilize a print out of the order available in the

High Court’s website, at par with certified copy, subject to attestation by the Advocate concerned with his/her seal, in the manner prescribed vide

Court’s Office Order dated 7th January, 2022.
