Judgment
Dr. Kauser Edappagath, J
The petitioner is the accused in C.C.No.487/2017 on the file of the Judicial First Class Magistrate-II, Kanjirappally. The offences alleged are punishable under Sections 294(b), 323, 406, 420, 498A read with 34 of IPC.
Non bailable warrant is pending against the petitioner. A look out notice has also been issued since he was abroad, to secure his presence.
The learned counsel for the petitioner Sri. Sunny Mathew submits that the petitioner would be arriving India tomorrow and he is prepared to surrender at the court below and ready to co-operate with the trial.
In these circumstances, this Crl.M.C is disposed of as follows:
(i) The petitioner shall surrender before the court below within two weeks from today.
(ii) The bail application, if any filed, shall be disposed of by the court below on the same day itself, in accordance with law.
(iii) Till the bail application is disposed of, all coercive steps initiated against the petitioner, including the look out notice pending against the petitioner shall be kept in abeyance.
(iv) The petitioner shall co-operate with the trial.
