1.The petition was filed by the father of the minor child for appointing him as the guardian of the said minor. Pursuant to negotiations, the parties have drawn up a child visitation agreement dated 11.02.2023. On perusal, the agreement has been signed by the petitioner / father of the child and the respondent / mother of the child.
Both parties are present in person. The agreement provides that the mother of the child shall have continued custody of the child until the child attains the age of majority. It contains detailed provisions with regard to the visitation rights of the father, including during occasions such as festivals, birthdays and holidays. It also provides for co-operation between the parents with regard to school, extra curricular activities, health care and the like. The agreement provides for the payment of monthly maintenance by the father of the child. It also provides for a review of the arrangement on an annual basis.
On examining the terms of compromise, I find no impediment to the disposal of this petition in terms thereof.
Accordingly, O.P.No.258 of 2022 is disposed of in terms of the child visitation agreement dated 11.02.2023, which shall form an integral part of the order. Consequently, A.No.3150 of 2022 is closed.
