Honourable Mr. Justice Vinod K. Sharma
The Petitioner has approached this Court with a prayer for issuance of a Writ in the nature of Mandamus, directing the second Respondent to produce the answer book of the Petitioner to verify the correctness of the evaluation.
Though the prayer made in the writ is only to get the answer sheet compared, the main grievance of the Petitioner is that, he has been wrongly rejected for appointment. According to the Petitioner, he had answered 115 answers correctly, out of total of 150 questions, therefore, should have been selected for appointment to the post of Graduate Assistant in the Government Middle/High/Higher Secondary Schools.
In view of the averments made in the Writ Petition that the Petitioner had answered all the 150 questions, out of which 115 answers were correct, and that the marks awarded to the Petitioner are only 80, the answer sheet along with Computer Evaluation was summoned. The answer sheet of the Petitioner and the result of the computer Evaluation shows that there is no error in awarding marks.
The Petitioner was rightly awarded 80 marks, therefore, failed to make the grade. It is not in dispute that a candidate getting 80 marks did not fall in merits for appointment.
In view of what is stated above, there being no merit in the Writ Petition, is ordered to be dismissed.
No costs.
