Heard on application filed under Section 439 of Cr.P.C. filed on 01.09.2020 for grant of bail on behalf of applicants namely Arjun @ Makram, Sukhchain, Laxmi and Rinku, who are confined in custody since 21.09.2019 and 23.09.2019 in connection with the Crime No. 319/2019 registered at Police Station, Ghanshore, District Seoni for the offences punishable under Sections 457, 380/34 of IPC.
It is submitted by the applicant's counsel that looking to the custody period and looking to the position arises out from the Covid-19, applicant should be enlarged on bail.
On the other side, the State strongly opposed the application.
It appears from the record that this is the second petition. First petition was dismissed on merits on 28.02.2020. Therefore, at present no any change circumstances are found for taking a different view. The applicant having previous criminal background, various properties have been seized.
Therefore, looking to the overall circumstances, applicants are not entitled to be enlarged on bail. Hence, the application is dismissed.
