Gopal Krishan Vyas, J.—Heard learned counsel for the petitioner. Admittedly, the petitioner is claiming appointment on the post of Teacher Gr. III on the ground that although he was not possessing qualification of BSTC on the last date which was 05.07.2004 for recruitment on the post of Teacher in pursuance of advertisement dt. 02.06.2004 but subsequently, he has acquired the said qualification because his result was declared late, therefore, it is prayed in the writ petition that the respondents may kindly be directed to treat the petitioner eligible for appointment on the post of Teacher Gr. III.

In the opinion of this Court, this controversy has ready been adjudicated by this Bench in S.B. Civil Writ Petition No. 1520/2013 Sita Seervi & Ors v. State & Ors, decided vide judgment dt. 13.09.2013 in which it has been held that if any candidate is not possessing qualification on the last date of submission of application form, then he cannot be treated eligible on the basis of result declared subsequent to the last date fixed for filling up application form, therefore, while following the aforesaid judgment in the case of Sita Seervi, this writ petition is hereby dismissed.
