ORDER
Ms. Prashansa Agrawal, Ld. Counsel for the Applicant is present.
The present Interlocutory Application has been filed by the Applicant, Hemant Kumar Shah, Resolution Professional of the Corporate Debtor, for replacing the Resolution Professional himself and to appoint Mr. Ankit Goel, as the Resolution Professional of the Corporate Debtor, as the Applicant got a Job Opportunity with a Government of India undertaking at Union Territory of Dadra & Nagar Haveli, Daman and Diu at Silvassa for the position of Chief Financial Officer.
However, the Applicant has proposed the name of Mr. Ankit Goel, CA IP, Designated Partner of AAA Insolvency Professionals LLP, having Registration No. IBBI/IPA-001/IP-P-02671/2022-2023/14088.
In that view of the matter, this Bench directs this Applicant to take instructions from the client whether Insolvency Professional is being appointed as designated partner or in his individual capacity by Committee of Creditors (CoC) as the Resolution passed by the CoC is not clear on this aspect.
Accordingly, stand over to 05.09.2023, for further consideration and hearing.
