Judgment
Aparesh Kumar Singh, CJ
Mr. Debalay Bhattacharya, learned senior counsel for the State and Ms. R. Guha, learned counsel for the private respondent, have not yet collected the Paper Book. They undertake to collect it by Friday (15.09.2023).
In view of the legal issues involved in the instant revision petition, this Court deems it proper to appoint learned senior counsel Mr. S.M. Chakraborty as amicus curiae to assist the Court.
Let the entire pleadings of the revision petition together with its annexures and the order sheet of the present proceedings and the Paper Book be supplied to learned amicus curiae by the Registry by 20.09.2023.
Learned amicus curiae is at liberty to take assistance of any junior counsel.
Considering the nature of the dispute and the legal issues involved herein, the matter is posted for hearing on 13.10.2023.
Learned counsel for the parties would submit their written notes by 06.10.2023. Written notes shall be exchanged between the parties and also served upon learned amicus curiae.
Learned amicus curiae would also submit his written notes along with the compilation of provisions of law and decisions on which he seeks to rely by 10.10.2023 through the Court Master.
Let the name of learned amicus curiae be reflected in the cause list henceforth.
