Judgment
Arindam Lodh, J
Heard Mr. S. Kar Bhowmik, learned senior counsel assisted by Mr. A. Bhattacharjee, learned counsel appearing for the petitioner as well as Mr. Ratan Datta, learned Public Prosecutor appearing for the respondent-State.
This application is filed under Section 439 CrPC for granting bail to the accused person, namely, Sri Dilip Barman, who is in custody for more than 96 days in connection with Khowai PS case no. 2023/KHW/033 under sections 22(c), 29 of the NDPS Act, 1985.
Mr. Kar Bhowmik, learned senior counsel has submitted that the accused is very sick.
The Superintendent of Jail/Jailor is directed to take appropriate steps for quick recovery of the accused, if necessary, the accused may be sent to AGMC & GBP hospital, Agartala / TMC, Hapania, for his immediate treatment.
List the matter on 13.07.2023 on which date learned Public Prosecutor shall produce the case diary relating to the instant case.
The Superintendent of Jail/Jailor is directed to submit the report as regards the treatment of the accused, Dilip Barman.
Registry is directed to communicate this order to the Superintendent/ Jailor of Khowai Jail.
