Judgment
This petition has been filed under Section 439 Cr.P.C. seeking regular bail to the petitioner in a case FIR No.37 dated 12.02.2017 under Sections 307,
452, 323, 325, 382, 511, 506, 148 and 149 IPC (Section 201 IPC added later on), registered at Police Station Derabassi, District SAS Nagar.
It is urged before the court that though petitioner is attributed injury with a rod, there is no evidence to show that the injury was dangerous to life.
Besides, petitioner is in custody since February 13, 2017. Only two prosecution witnesses have been examined till date.
Learned State counsel has opposed the prayer for bail on the ground that petitioner is involved in other cases as well and prosecution has sufficient
evidence to sustain prosecution.
However, keeping in view period of incarceration of the petitioner and the fact that the trial may still take some time to conclude, no useful purpose
would be served by detaining the petitioner any longer. Thus, without expressing any opinion on the merits of the case, this petition is allowed.
Petitioner is directed to be enlarged on bail to the satisfaction of Chief Judicial Magistrate/Duty Magistrate, SAS Nagar (Mohali).
