Judgment
Heard. Connect with Appeal No. 442 of 2022. Affidavit in reply may be filed within a period of five weeks from today. Affidavit in rejoinder, if any, thereafter within a period of three weeks. Place this appeal for admission and for final disposal on Septembers 29, 2022.
So far as the appellant is concerned, the record would show that the appellant was the member of the treasury committee of FHSL. The allegation against the appellant is found to be similar to the appellant in appeal no. 444 of 2022 by the learned AO as can be seen from the paragraph no. 74 of the Impugned order. The allegation against him is that for three transactions of lending money, the proposal came before him. The record would show that there are 69 transactions of the similar fashion. The present appellant is an employee of the concerned entity.
Considering all these facts on record, the effect and operation of the impugned order shall remain stayed in so far as it relates to the appellant subject to deposit 10% of the penalty amount imposed upon him within four weeks from the date of this order.
This order will be digitally signed by the Private Secretary on behalf of the bench and all concerned parties are directed to act on the digitally signed copy of this order. Certified copy of this order is also available from the Registry on payment of usual charges.
