Mr. Mohanty, learned advocate appears on behalf of petitioner and submits, his client is aggrieved by the oil company obtaining access for fuel station 246 meters away from the plot, regarding which his client has been awarded a Letter of Interest (LOI). He submits, there is another writ petition in W.P.(C) no.13372 of 2014 regarding confusion created by his co-sharer having filed civil suit in respect of his self acquired plot, subject matter of the LOI.
On query from Court, Mr. Rath, learned advocate appearing on behalf of the oil company submits, there can be two fuel stations separated by 246 meters on the same highway. Mr. Rath submits, the clearance given in respect of petitioner's offered plot has since been revoked as cancelled by letter dated 16th July, 2021 issued by the Collector, Bargarh. The oil company is requested to circulate said letter dated 16th July, 2021 to appearing parties.
List on 5th January, 2022 along with W.P.(C) no.13372 of 2014.
Interim order passed earlier shall continue till next date.
