Judgment

On 14.08.2020, the applicant – Anuj Kumar Gupta was granted regular bail under Sections 409, 420, 466, 467, 468, 471 and Section 120 B of the Indian Penal Code, 1860 in connection with the First Information Report No.285 of 2019, registered at police station Jaspur, District Udham Singh Nagar.
The bail was granted during the course of the investigation. A charge-sheet has been filed by the Investigating Officer adding Section 7A and Section 8 of the Prevention of Corruption Act, 1988.
The present Application has been filed under Section 482 of the Code of Criminal Procedure, 1973 to direct the court concerned to release the applicant on the same bail bonds or to accept fresh bail bonds.
Once accused was released on bail for the offence during the course of the investigation and later on if during the investigation one other section is added, the order which can be passed by the court concerned is to ask the accused to furnish personal bond and surety for the offence added in the charge-sheet.

Having heard the learned counsel for the parties, the present Application, filed under Section 482 of the Code of Criminal Procedure, 1973, is allowed to this extent that the applicant – accused, namely, Anuj Kumar Gupta is permitted to continue to remain on bail also under Section 7A and Section 8 of the Prevention of Corruption Act, 1988, provided he furnishes fresh personal bond and sureties to the satisfaction of the court concerned.
