Judgment

It is submitted by the learned counsel for the petitioner that as fixed for today by the learned trial court, though cross-examination continued before the learned court for some time, due to change in timing of the courts for the summer season, as prevailing today, cross-examination could not be completed. It is also stated that the next date is fixed to 11.05.2023 for continuance of the cross-examination. It is submitted a prayer will be made before the learned trial court for continuous dates for cross-examination.
Learned counsel for opposite party fairly submits that since such prayer made by the learned counsel for the petitioner is without prejudice to any of the parties to the litigation, they would have no objection if any order is passed by the learned trial court in accordance with law if such prayer is made.
Having heard learned counsel for the parties, in the interest of justice and equity it is observed that if any prayer is made before the learned trial court/petition is filed, same shall be considered in accordance with law so as to enable the proceeding to be expedited and the cross-examination can be done at an early date.
It is submitted by learned counsel for the petitioner that they shall move the learned trial court for giving dates on 10th, 11th and 12th of May. Accordingly, learned court below shall consider the same in accordance with law for grant of time for effective hearing/cross examination.
As agreed by the learned counsel for the parties, list this matter on 12.05.2023.
