Petitioners have challenged the order dated 25.03.2022 passed by Chairman, Bar Council of Uttarakhand, which provides that the excess amount of A.C.P. paid to the petitioners shall be recovered in four instalments.

Mr. Piyush Garg, Advocate for the respondents has produced in Court an order dated 29.03.2022.

Perusal of the said order reveals that Chairman, Bar Council has instructed the Secretary to issue show-cause notice to the petitioner as to why the amount sought to be recovered be not recovered from them in four instalments.

Mr. Piyush Garg, Advocate appearing for the respondents fairly submits that he has been instructed to make a statement that the show-cause notice to be issued to the petitioners, would be on merits of petitioner’s entitlement to retain the benefit of A.C.P. given to them and it would not be limited to mode of recovery.

Accordingly, the writ petition is disposed of by taking the statement made by Mr. Piyush Garg, Advocate for the respondents, on record.
