Judgment
Harnaresh Singh Gill, J
Case is being taken up for hearing through video conferencing. The petitioner seeks regular bail in FIR No. 97 dated 28.6.2018 under Sections 302, 307, 148, 149, 120-B and 452 IPC (added later on) registered at Police Station Bhogpur, District Jalandhar Rural.
Learned counsel for the petitioner submits that co-accused Mandeep Singh @ Manna has been granted regular bail by the Co-ordinate Bench of this Court on 30.1.2019. Moreover, as per the learned counsel for the petitioner, the petitioner has been implicated in the present case on the basis of confessional statement suffered by co-accused Gulshan Kumar. Learned counsel further submits that petitioner has been in custody since 30.6.2018 and there is no other case pending or decided against him.
Learned State counsel submits that in the present case, challan has been presented and the charges are yet to be framed.
The petitioner has been in custody since 30.6.2018. Co-accused 1 of 2 Mandeep Singh @ Manna has been granted regular bail. Challan has been presented but the charges are yet to be framed. The trial will take time to conclude. No useful purpose would be served by keeping the petitioner behind the bars.
Without commenting anything on the merits of the case, the petition is allowed and the petitioner is ordered to be released on bail on his furnishing bail/surety bonds to the satisfaction of the trial Court/Duty Magistrate.
