Judgment
The petitioner has approached this Court seeking direction to the respondents/authorities to expeditiously consider and dispose of the pending
proceedings initiated at the behest of the petitioner concerning alleged construction of illegal shops and rooms in survey no. 3/1 of village Dabolim by
the respondent no.5.
The record shows that against final notice of demolition issued by the respondent/Panchayat, an appeal has been filed by the respondent no.5 before
the respondent/Additional Director of Panchayats and the same is pending. It is further found from the record that a complaint was lodged by the
petitioner before the respondent/Deputy Collector raising grievance about aforesaid alleged illegal construction of shops and rooms. The principal
grievance of the petitioner is that the complaint and the appeal are not being considered expeditiously.
Mr. D. Pagnam, learned Advocate General, alongwith Mr. S. Priolkar,learned Addl. Govt. Advocate, has appeared on behalf of the
respondents/authorities and he submits that he would take instructions in the matter.
We are of the opinion that Writ Petition can be disposed of by giving appropriate directions. Accordingly, the Writ Petition is disposed of by
directing respondent no.3/Deputy Collector to take up the complaint filed by the petitioner for consideration and pass appropriate orders thereon by
30.3.2022.
Similarly, respondent no.6/Additional Director of Panchayats is directed to take up the pending appeal filed by the respondent no. 5 for consideration
and dispose of the same expeditiously and in any case on or before 30.3.2022.
