Judgment

The above writ petition is filed with following prayers :
“a) To issue a writ of mandamus or order or direction, commanding the respondents 1 and 2 to consider Exhibit P2 Permanent disability certificate issued to the petitioner by considering the actual physical disability which is suffered by the petitioner and direct the respondents to include the petitioner in the KEAM 2023 PWD category rank list, in the interest of justice.
b) To issue a writ of mandamus or order or direction commanding the respondents 1 and 2 to consider the Exhibit P9 representation of the petitioner and expeditiously pass appropriate orders on the same, in the interest of justice.
c) To dispense with the filing of the translation of the vernacular documents.
d) Issue such other writ, direction or order this Honorable Court deem fit and proper for the facts and circumstances in this case.” [SIC]
The petitioner is a 'physically disabled' medical student aspirant who appeared for the 'KEAM 2023' examination. The petitioner applied under the PWD (Persons with Disability) quota. But on verification, the authorities are not ready to accept Exts.P1 and P2 issued by the Medical Board and they conducted an independent medical examination for the petitioner is the submission. As per Exts.P1 and P2, the disability is 40%. Hence, this writ petition is filed.
Heard the learned counsel for the petitioner and the learned Government Pleader.
The Government Pleader submitted that the State Medical Board assessed the disability of the petitioner and found that the disability is only 30%. But the petitioner has got a grievance and the same is raised by the petitioner in Ext.P9 representation before the 2nd respondent. If that is the case, there can be a direction to the 2nd respondent to consider the same forthwith.
Therefore, this writ petition is disposed of with the following directions :
1) The 2nd respondent is directed to consider and pass appropriate orders in Ext.P9 as expeditiously as possible, at any rate, within two days from the date of receipt of a certified copy of this judgment.
2) The petitioner will appear and produce a copy of this judgment along with a copy of this writ petition before the 2nd respondent.
