Judgment
This matter is listed in the “Prioritised Cases” category.
The Petitioner approached this Court on the ground that she was wrongly shown to have scored 200 marks out of 450 marks and was, therefore, declared to have failed. This Court (Coram: Bilal Nazki and A.P. Bhangale, JJ.) passed a detailed interim order dated 17th April, 2008, prima facie concluding that four Professors were involved in the tampering of records and that the Petitioner was also, prima facie, instrumental in converting the middle digit ‘0’ (zero) in the figure ‘200’, into ‘8’, thereby making it appear as ‘280’.
By an order dated 23rd July, 2008, passed by this Court (Coram: R.M.S. Khandeparkar and A.A. Sayed, JJ.), the affidavits of the four Professors were accepted and they were discharged. We are now informed that the Petitioner thereafter has already taken the re-examination.
In view of the above, we do not find that the cause of action survives after 17 years.
This Petition is, therefore, disposed off, as being infructuous.
Rule is discharged.
