Judgment
The hearing was conducted through Video Conferencing.
Pursuant to the second order passed on 01.04.2020, a Committee was constituted by the Director of Max Super Speciality hospital, Saket to
evaluate the case of the petitioner and to ascertain whether there could be any potential risk to the minor in donating a part of the liver.
The advice of the Committee dated 02.04.2020 has been placed on record by Mr. Naushad Ahmad Khan, Standing Counsel for the Government of
NCT of Delhi. As per the advice, the Committee is of the view that there could be potential negative impact on physical and physiological health of the
petitioner, in short term as well as long term in donating part of the liver to her father.
Mr. Sikri, learned counsel appearing for the petitioner submits that the direction issued by order dated 01.04.2020 was to constitute a committee of
which one member had to be an expert in Liver Transplant and Biliary Sciences to consider the case of the petitioner. He submits that the constitution
of the Committee shows that the members of the Committee were Director, Haematology and Gastroenterology and Senior Director and Head
Gastroenterology Department. He submits that no expert of Liver Transplant and Biliary Sciences was a member of the Committee.
In view of the above, Director, Max Super Speciality Hospital is directed to clarify as to whether any one of the committee members is an expert in
Liver transplant and Biliary sciences and if not then the opinion be also taken from an expert in Liver Transplant and Biliary Sciences and forwarded
to the respondents by 2 PM on 05.04.2020.
