Judgment
A. Muhamed Mustaque, J.
The petitioner is the respondent/tenant in RCP No.65/2022 on the file of the Rent Control Court, Ernakulam. He was set ex parte. An application for setting aside the ex parte order is pending. In the meanwhile, the respondent/landlord filed execution petition. Facing the threat of delivery, the petitioner has approached this Court.
Having considered the facts and circumstances, we order that till the application to set aside the ex parte order is considered and disposed of, the proceedings in the execution petition shall be kept in abeyance. The Rent Control Court, before whom the application to set aside the ex parte order is pending, shall expeditiously dispose of the application having considered the nature of the order. If the present court is vacant, the court having additional charge shall take up the application and dispose of the same at the earliest.
The OP(RC) is disposed of, as above.
The petitioner shall serve a copy of this order on the counsel appearing for the respondent/landlord before the court below.
