Judgment
A.Muhamed Mustaque, J
The petitioner is the respondent in O.P No.1387 of 2017 on the file of the Family Court, Ernakulam. He was set ex-parte. He filed an application to set aside the ex-parte decree along with an application to condone the delay of about 575 days. These applications are pending.
In the meanwhile, based on the execution petition, he was arrested and put in the jail.
In view of the fact that the applications are pending before the Family Court, Ernakulam, we pass the following order:
i) The petitioner be forthwith released from the jail.
ii) we also direct the Family Court, Ernakulam to pass appropriate orders on Exts.P7 and P8 application within a period of four weeks.
iii) Till the disposal of the applications as above, the execution petition will stand deferred.
iv) Registry is also directed to communicate this order to the Jail Superintendent, Viyyur Jail, Thrissur forthwith.
v) We direct the Family Court to reschedule the hearing of the applications to 20.06.2022.
