The present petition has been filed by Anoop Kumar for grant of anticipatory bail in case FIR No.672 dated 13.10.2021, registered under Sections 18, 27A, 29 of NDPS Act, 1985 at Police Station Shahabad, District Kurukshetra.
The argument raised is that the petitioner has been implicated on account of the fact that he has been named by Ajit Singh @ Pinder, who was apprehended at the spot, from whom 26.5 Kgs. of opium was recovered. Further, it is submitted that the petitioner has been falsely implicated on account of the reason that he had approached this Court for seeking anticipatory bail in an earlier case FIR No.571 dated 05.10.2020, registered under Sections 18/29 of the NDPS Act, 1985 at the same Police Station.
It is not disputed that the petitioner is also a convict in an earlier FIR No.324 dated 03.09.2010, registered under Sections 15, 8, 29, 25, 27A and 31 of the NDPS Act, 1985 at Police Station Shahabad, District Kurukshetra and his sentence has been suspended by this Court.
In such circumstances, keeping in view the fact that the petitioner has a history as such, this Court is not inclined to exercise its extraordinary jurisdiction for granting benefit of anticipatory bail to a person who has criminal antecedents.
Resultantly, the present petition is dismissed.
