The present writ petition has been filed under Articles 226/227 of the Constitution of India seeking issuance of a writ in the nature of MANDAMUS directing the respondent No.1 to give promotion to the petitioner on the post of Secretary, Municipal Committee from the date when respondent No.4, who is junior to the petitioner was given such promotion along with all consequential benefits and also to re-fix the seniority list pertaining to the post of Secretary and with a further prayer that the operation of the impugned promotion order dated 27.05.2022 (Annexure P-4) vide which respondent No.4 has been promoted to the post of Secretary may kindly be stayed to the extent that the petitioner be granted promotion on the same date i.e. on 27.05.2022 along with all consequential benefits.

Learned counsel for the petitioner submitted that the petitioner was entitled for the aforesaid benefits, which have been so mentioned in the head note of the present writ petition and in this regard, she had served a representation dated 13.12.2023 (Annexure P-9) to the Additional Chief Secretary, Urban Local Bodies Department, Chandigarh but the same has not been considered and decided till date. He further submitted that at this stage, the petitioner will be satisfied in case the aforesaid representation dated 13.12.2023 (Annexure P-9) is considered and decided in accordance with law and in a time bound manner.

Notice of motion.

On the asking of the Court, Mr. Samarth Sagar, Addl. A.G., Haryana, accepts notice on behalf of respondents No.1 and 2 only. He submitted that in view of the limited prayer made by learned counsel for the petitioner, he has no objection in case time bound direction is issued by this Court in this regard.

In view of the aforesaid facts and circumstances, without calling for the reply from respondents No.1 and 2 and without expressing anything on the merits of the case, the present writ petition is disposed of with a direction to respondents No.1/respondent No.2/competent authority to consider and decide the representation dated 13.12.2023 (Annexure P-9) of the petitioner, strictly in accordance with law and within a period of two months from today.
