Heard the parties.
The applicant, who is in custody since 18.03.2023, has renewed the prayer for grant of regular bail in connection with S.T. No.295 of 2023 arising out of Sadar P.S. Case No.59 of 2023 registered for the offence under Sections 302/201/120(B)/34 IPC, pending in the court of A.D.J., 1st, Chatra.
Earlier the prayer for bail of the applicant(s) has been rejected vide order dated 10.08.2023 passed in B.A. No.6610 of 2023.
Innocence has been claimed and participation in the trial has been assured. It has been submitted that the trial is going on and further, five witnesses have already been declared hostile. On the above facts, prayer for bail has been renewed.
On the other hand, learned A.P.P. has opposed the prayer for bail and it has been submitted that the contested witnesses have supported the case.
Considering the nature of the offence and the material available on the record, I am not inclined to enlarge the applicant (s) on bail. Accordingly, the prayer for bail of the applicant(s) is rejected again.
However, trial court is directed to expedite the trial and conclude it as early as possible.
